Acceptable Use Policy

This Acceptable Use Policy ("AUP") applies to all content uploaded to Migaki at migaki.moe and to all use of the Service. It is part of our Terms of Service.

Migaki is an image enhancement and upscaling tool for digital artists who work in 2D and stylized digital illustration. It is not a prompt-to-image generator, marketplace, face-swap tool, or likeness service.

Violation of this AUP may result in a blocked job, warning, suspension, or account termination. Serious safety or legal issues may be reported to the appropriate authorities.

1. What You May Upload

You may upload images only if all of the following are true:

1.1 The image is a 2D or stylized digital illustration (not a real-person photograph or a photo-realistic image of a real human).

1.2 You own the image, created it yourself, or have a license or permission to process it.

1.3 The image and your intended use comply with applicable law and third-party rights.

1.4 You are responsible for ensuring your content and intended use comply with these rules, the Content Policy, and applicable law.

2. Prohibited Content

Do not upload, process, request, share, or attempt to generate any of the following:

2.1 Explicit or Age-Restricted Material

  • Pornographic, sexually explicit, lewd, or age-restricted material
  • Nudity, whether real or illustrated
  • Sexualized poses, framing, or presentation

2.2 Content Involving Minors

  • Any content depicting minors in sexualized, exploitative, or unsafe contexts
  • Any illustrated character who appears under 18 in sexualized or suggestive contexts, regardless of fictional age claims
  • Any imagery that could be interpreted as child sexual abuse material under applicable law

We apply a zero-tolerance policy to child-safety violations and may report them to the appropriate authorities.

2.3 Real Persons

  • Real-person photographs or photo-realistic real-person imagery
  • Realistic human likenesses without explicit consent
  • Deepfakes, face swap, identity manipulation, or impersonation of real persons
  • Mixed media that combines art with real human elements (e.g., real face placed on an illustrated body)

2.4 Non-Consensual and Violent Content

  • Non-consensual intimate imagery
  • Bestiality or sexual content involving animals
  • Graphic violence, gore, mutilation, torture
  • Content glorifying or instructing real-world violence, terrorism, or self-harm
  • Other extreme abuse or illegal content

2.5 Illegal Content

  • Content that violates applicable law in your jurisdiction
  • Content depicting real criminal acts
  • Content involving human trafficking, slavery, or coercion

2.6 Hate and Discrimination

  • Content promoting hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, national origin, or similar protected characteristics
  • Symbols of hate organizations used to glorify hate

2.7 Intellectual Property Infringement

  • Copyrighted or trademarked images you do not have rights to
  • Style impersonation intended to defraud (presenting AI-enhanced output as the work of a specific real, identifiable artist without disclosure)

2.8 Fraud and Impersonation

  • Content created to defraud, scam, or deceive others
  • Impersonating another person, brand, or organization
  • Phishing, malware, or content designed to deceive Migaki's systems

3. Service-Level Restrictions

3.1 No Bypassing Moderation

You may not use obfuscation or other techniques to bypass content moderation; you may not use multiple accounts to evade bans or moderation flags.

3.2 No Automated Abuse

You may not use bots, scripts, or automated agents to flood the Service; you may not scrape the Service or attempt to extract our models or internal systems; you may not reverse-engineer the API or attempt unauthorized access.

3.3 No Resale or Competing Use

You may not resell, redistribute, or commercialize the Service as a competing offering. Subscriptions are for one user. Output usage for your own creative or commercial work (within these rules) is allowed.

4. Enforcement

4.1 Automated and Discretionary Moderation

We may use automated content moderation at the upload and output stages to help apply this AUP. We do not pre-screen or manually review every image, and we do not guarantee that any given upload or output will be reviewed, blocked, or permitted. We may, at our sole discretion, block a job, refuse or remove content, limit functionality, or suspend an account. You are solely responsible for the content you upload, process, and generate.

4.2 Human Review

Suspected violations may escalate to human review. We do not store inputs or outputs beyond the standard retention windows described in the Privacy Policy.

4.3 Account Actions

Depending on severity:

  • First minor violation: Warning; the allowance units deducted for the blocked job are automatically returned to your balance
  • Repeated minor violations: Temporary suspension
  • Major violation (e.g., child-safety material, real-person likeness without consent, deepfake, or IP infringement at scale): Account termination and potential legal action

4.4 Cooperation with Authorities

We cooperate with law enforcement on properly-served legal requests and report child-safety violations where required.

  • Child-safety emergencies: report directly to the relevant child-safety hotline or local authority

6. Updates

This AUP may be updated. Material changes will be communicated by email and posted on this page.
